Do all companies have to register with the Department of Ports and Customs? 

 Companies must register and obtain the importer code that authorizes them to apply for customs services. 

What are the procedures that license holders need to clear goods for the purpose of selling them in the local market? 

The license holder must obtain the importer code, through which the appropriate customs declaration is submitted, and some goods require special approvals and permits from the competent authorities, so these approvals must be issued to release the goods, and the approvals must be submitted with other required documents to the customs authorities to complete the procedures customs clearance. 

Who are the persons authorized to clear goods? 

1. The company that has an import code issued by the Department of Ports and Customs. 
2. The owner of the goods registered with the Department or his representative or the authorized customs broker 

What is the percentage of customs duties imposed at the Department of Ports and Customs?

What are the different customs valuation methods allowed under the customs valuation agreement? 

Value the imported goods according to the following criteria which shall be applied in the order mentioned below: 
1. Imported goods transaction value method. 
2. The transaction value of similar goods. 
3. The transaction value of similar goods. 
4. Reduced value based on the following selling price in the importing country 
5.The computed value based on the cost of materials, manufacturing, cost, overheads, handling costs and profits in the country of origin 
6. The flexible method, where the mentioned methods (from 1 to 5) are used in a more flexible way but in the same order. 

What are the procedures to be followed in case of doubt about the credibility or accuracy of the value stated? 

In the event that a customs declaration is submitted and the customs officers have reasons to doubt the reliability or accuracy of the statements provided or the documents submitted as part of the customs declaration, then the customs officers may request the importer to provide additional clarifications, Including any documents or other evidence that the declared value represents the total amount actually paid or payable for the imported goods, as adjusted using valuation factors, if more information is obtained. 

Does the customs value include charges related to shipping, insurance, loading, unloading and delivery? 

The customs value of the goods imported into Ajman is based on the principle of cost, insurance and freight in accordance with the unified customs law of the countries of the GCC and its executive regulations and related explanatory notes. The value of the imported goods is equal to the value included in the customs declaration plus the cost until the goods reach the port of destination in the GCC countries. 
The cost includes insurance and freight, transportation fees, insurance and other fees until arriving at the place of import. 

How is the customs value calculated if the currency of the importing country differs from the currency normally used to pay the value of goods purchased from abroad? 

The foreign currency exchange rate will be adopted at the time of submission of the customs declaration to calculate the customs duties. 

Does the importer have the right to file a grievance against the decisions issued by the customs administrations regarding the customs assessment? 

Yes, Article 11 of the Customs Valuation Agreement states that the legislation and laws of the member states must provide for the right to appeal without imposing any penalty on the specified customs value. This appeal can be submitted to the Value Adjudication Committee.

Are there special exemptions for the 5% customs rate? 

Yes, it is as follows: 
1.All shipments exported outside the country are exempt from customs duties 
2. Import shipments of used personal effects are exempt from customs duties 
3. Shipments of national factories are exempt from customs duties under the industrial exemption and require approval from the competent authorities. 
4. Imports of the diplomatic and military corps are exempt from customs duties and require approval from the competent authorities. 
5. Goods are subject to customs taxes “duties” in accordance with the unified customs tariff, except for what is excluded under the provisions of the unified customs “law” of the GCC states or under the economic agreements of the GCC states in effect or any other international agreement within the framework of the council. 
6.Imports of charities and organizations require approval from the competent authorities. 
7. Imports of origin to the Gulf and Arab countries, provided that a certificate of origin is available. 

Do the X-ray spaces used by Department pose a health risk? 

All equipment used by the department meets the strict health and safety requirements and regulations set by the Federal Authority for Nuclear Regulation. 

Is the TAX different from Customs Fees? 

Yes, the due customs fees of 5% of the value of the goods are for customs. As for the value-added fees determined by the Federal Tax Authority, they belong to them.
